Well, you'd have to be daft to appeal a judgement as dismissive as this one.

So the likelihood of an appeal was always pretty high.

If they are appealing i'd urge everyone to fight for them to have to pay costs for the initial case. They are basically doing all this at little expense, knowing full well they wont win. My guess is if the Council pursue them for costs they wont have the funds to take this any further

They really must have some big funding behind them as they are going to have to pay for another appeal and surely pay the councils costs if they lose again.

Two years - if I was a parent with a child at the school or going to the school I would be livid, and that is putting it mildly.

Before we all get overheated let's wait and see if the appeal is lodged. I understand they have until close of business today.

It is an odd choice of langauge for the day on which an appeal must be lodged. Why bother vowing just do it.

If they do lodge an appeal and two years is the delay i really think some sort of action group should be mobilized to lobby the council to go after them for fees and start exerting real pressure on these old farts. It's nigh on disgraceful what they are doing to the children who will miss out on those facilities.

It is made worse by the fact they have absolutely NO legal grounds on which to launch an appeal as was made abundantly clear at the last one

No point in getting overheated. PPAG have lost every battle so far and that ain't changing anytime soon.

I get the feeling this may be the straw that breaks the camels back, parents have had enough of this now, myself included. I was ok with them appealing once on whatever tenuous grounds they used but to deliberately leave it so late and now to rsk a further delay of TWO YEARS, when the appeal Judge effectively threw it out is shameful

parents and the council should mobilise now and force PPAG to pay all legal costs and whatever else it takes. cEC need to front up now and show some fight

PPAG have had their time in the sun and people in Portobello now need to start standing up to them and calling for PPAG to pay costs rather than waste our council taxes on yet another fruitless appeal. In the current financial climate, should we really accept people wasting money in this way simply to delay things by 2 years?

Write to your councillor and copy Kenny MacAskill, I have, others have and if we all do, get something in the press etc then the pressure is on them to go after these people for costs.

Make sure you write to the reps. request they bring all of their influence to bear to bring this to a just conclusion AND ensure PPAG pick up all the costs .

A two year delay would, I imagine, push building costs up . Anyone know if the Council would have to go through the whole tendering process again? If this is the case, then not only should the Council pursue court costs , but should pursue recompense for any additional costs.

I can't believe that PPAG are appealing this.
